Delhi Child Custody & Visitation FAQs

Frequently Asked Questions: Child Custody & Guardianship Law

Under the Guardians and Wards Act, 1890 (GWA) and Section 13 of the Hindu Minority and Guardianship Act, 1956 (HMGA), the 'Welfare of the Child is the Paramount Consideration.' The Supreme Court has repeatedly affirmed (Gaurav Nagpal v. Sumedha Nagpal) that parental rights, financial wealth, or gender do not supersede the minor child's physical, emotional, moral, and educational well-being. Delhi Family Court judges evaluate which parent provides emotional security, educational stability, a peaceful moral atmosphere, and genuine bonding, rather than mechanical parental claims.
Under Section 6(a) of the Hindu Minority and Guardianship Act, 1956, the custody of a minor child who has not completed the age of 5 years ordinarily remains with the mother. Indian courts recognise the mother's biological and emotional indispensability during tender infant years. However, this presumption is not absolute. If a father proves through clear, verifiable evidence that the mother suffers from severe mental illness, substance abuse, chronic physical neglect, abandonment, or exposes the infant to danger, Delhi Family Courts will award custody to the father to safeguard the child's life.
Delhi Family Courts actively discourage parental alienation and recognize that a child requires the love and affection of both parents. While custody litigation is pending, the non-custodial parent is entitled to comprehensive interim visitation rights: 1) Physical Weekend Visitation: Meeting the child on alternate Saturdays/Sundays at the Family Court Children's Room (Creche) or mutually agreed public locations (malls, parks); 2) Overnight Visitation: Weekend stays once the child is comfortable; 3) Festival & Birthday Sharing: Sharing major festivals (Diwali, Holi, Christmas, Eid) and child’s birthday on alternate years; 4) School Vacation Sharing: Dividing 50% of summer and winter school vacations; and 5) Virtual Access: Daily or alternate-day video calls on WhatsApp/FaceTime for 15–30 minutes without custodial parent interception.
Yes. A father can successfully secure sole or primary physical custody in Delhi Family Courts under several well-established circumstances: 1) Proving that the mother has willfully abandoned the child or shown persistent emotional neglect; 2) Proving the child's stable school enrollment and academic routine is rooted in the father's home environment; 3) In cases involving children aged 9 years or older, where the child clearly expresses an intelligent preference to reside with the father during an in-camera interview with the Family Court Judge; 4) Proving severe parental alienation or toxic home environment created by the maternal household; or 5) Demonstrating superior caregiving support from paternal grandparents in a stable joint family setting.
Parental Alienation Syndrome (where the custodial parent systematically brainwashes and instills hostility in the child against the other parent) is viewed very strictly by Delhi Family Courts and the Supreme Court (Vivek Singh v. Romani Singh & Perry Kansagra v. Smriti Madan Kansagra). When alienation is alleged, our lawyers move urgent applications for: 1) An in-chamber interaction between the judge and child; 2) Referral to court-appointed clinical child psychologists or counselors for independent mental evaluation; 3) Immediate unsupervised visitation to rebuild parental bonding; and 4) In severe cases of persistent alienation, modification of custody orders and transfer of physical custody to the alienated parent.
Yes. Under Section 26 of the Hindu Marriage Act and Section 25 of the Guardians and Wards Act, custody and visitation orders are never final or unalterable; they are interlocutory and dynamic in nature. Any parent can file an application for modification of custody or visitation upon demonstrating a substantial change in circumstances. Valid grounds for modification include: remarriage of the custodial parent impacting child welfare, relocation/transfer out of Delhi, decline in child's academic or physical health, improvement in non-custodial parent's lifestyle, or the child reaching an age where they express a clear desire to live with the other parent.
